Overview

A geographical Indication (GI) is a name or sign used on certain products that have a specific geographical location and possess qualities or a reputation that attribute to a specific geographical origin (e.g. a town, region, or country).

There is a prominent link between the product and its original place of production since the qualities depend on the geographical place of production.

  • A GI registration acts as a certificate and ensures that similar products from elsewhere cannot be sold under the same name.
  • There are several products which may constitute of a Geographical Indication. These include agricultural products, edible items, wine, spirit drinks and handicrafts.

Validity of a GI Registration

  • A GI registration is valid for 10 years, after which it can be renewed subsequently.

Registration under the Geographical Indications of Goods (Registration and Protection) Act, 1999

  • An application for registration must be made before the Registrar of Geographical Indications by any association of persons or producers or any organization or authority established under the law, representing the interest of the producers/manufacturers of the concerned goods.

The application must contain the following :

  • A statement as to how the Geographical Indication serves to designate the goods as originating from the concerned territory in respect of a specific quality, reputation, or other characteristics.
  • Geographical map of the territory
  • The particulars of the appearance of the geographical Indication word or device features or both
  • List of producers
  • An Affidavit stating how the Applicant claims to represent the interests of the association of persons or producers.
  • The standard benchmark for the use of the Geographical Indication with regards to the production, exploitation, manufacture/making of the goods having specific quality, reputation, or distinguishable characteristics attributable to that geographical origin.
  • Details relating to the mechanism in order to ensure the standards, quality, characteristics maintained by the producers/manufacturers.
  • Details of human skills involved or the uniqueness of the geographical environment or other inherent characteristics associated with the Geographical Indication.
  • An executed Power of Attorney is required.
